Defending Brain SPECT Imaging Test for Traumatic Brain Injuries

This program discusses: The presentation will focus on updating the current case law involving the admissibility of SPECT scans in the litigation of claims involving traumatic brain injuries and what has worked to keep SPECT scan evidence from being admitted into evidence.

Power Point Presentation will provide information on cases from 2018 – 2020 in Colorado and other jurisdictions who have litigated the admissibility of SPECT scans and how the defense presented their arguments against its admissibility, and the arguments presented from plaintiff’s counsel.

I will provide recommendations for attacking the admissibility of SPECT scans in TBI cases based on the experience of other defense counsel from the cases covered.

Colorado Equal Pay Act

The Colorado Equal Pay for Equal Work Act goes into effect January 1, 2021. The Act is Colorado’s response to the wage gap between men and women. It prohibits all employers from discriminating in the amount or rate of employees’ wages solely on the basis of an employee’s gender. The Act creates a private cause of action similar to, but broader than, the federal Equal Pay Act, and it creates transparency measures enforceable by the Colorado Department of Labor and Employment to provide employees more information about promotional opportunities, pay ranges, and the historical pay practices at a given place of employment. Unlike the federal Equal Pay Act, which allows employers to assert a “catch all” affirmative defense by relying on “any other factor other than sex,” Colorado’s law provides just several reasons to justify a pay disparity.

Attendees will learn the differences between the federal and Colorado Equal Pay Acts, in preparation for defending state claims beginning next year. Attendees will also be versed on the outcome of past federal Equal Pay Act cases.

The discussion will also include an overview of national trends and legislation that is likely to be introduced in the 2021 Colorado legislative session.

We rely heavily on in-person CLEs for our educational seminars, but the COVID-19 virus has changed our method of delivery. Therefore, the Colorado Defense Lawyers Association will conduct webinars and promote them until further notice. The July 2020 Conference has been cancelled but we are excited that in July 2021 two Past Presidents, Jan Spies and Rob Jones will be co-hosting their conference in Tamaya, New Mexico, right outside Santa Fe.
