Covid-19 Resources

We rely heavily on in-person CLEs for our educational seminars, but the COVID-19 virus has changed our method of delivery. Therefore, the Colorado Defense Lawyers Association will conduct webinars and promote them until further notice. The July 2020 Conference has been cancelled but we are excited that in July 2021 two Past Presidents, Jan Spies and Rob Jones will be co-hosting their conference in Tamaya, New Mexico, right outside Santa Fe.

Legislative Update

The 2021 legislative session is in full swing! CDLA is monitoring many bills but here are a few of the more important ones we are following:

HB 1188 - Additional Liability under Respondeat Superior (current status: active): This bill attempts to overturn the Supreme Court decision in Ferrer vs. Okbamicael and Colorado Cab Company regarding respondeat superior. Ferrer held that when an employer admits liability for the tortious actions of its employee, the plaintiff cannot assert direct negligence claims against the employer arising out of the same incident. The bill allows a plaintiff to bring such claims against an employer or against a principal that admits liability for the actions of its agent. SB 169 - Restricting Insurers' use of External Consumer Data (current status: active): This bill seeks to restrict an insurer from considering an individual's race, color, national or ethnic origin, religion, sex, sexual orientation, disability, or transgender status in any insurance practice or from using any external data that unfairly discriminates based on these factors. SB 176 - Employment Discrimination (current status: active): The title of this bill is the "Protecting Opportunities and Workers' Rights (POWR) Act and it seeks to amend Colorado's anti-discrimination law in many ways. It changes the definition of several key terms such as "employee," "harassment," and "hostile work environment," and imposes obligations on employers to investigate unfair employment practices. It also eliminates the requirement for employees to exhaust their administrative remedies. This is major bill with important ramifications for employment attorneys. SB 184 - Ski Area Safety Plans and Accident Reporting (current status: active): This bill requires ski operators to adopt and disclose a safety plan and disclose ski accidents statistics and maintain an accident database. SB 61 - Claims for Economic Damages Incurred by Minors (current status: active): This bill permits a minor to bring a claim to recover damages for the minor's pre-majority economic losses and extends the statute of limitation for pre-majority economic damages.
