He is a member of the American Board of Trial Attorneys, a membership reserved for lawyers demonstrating high personal character and honorable reputation and which is by invitation only. He is recognized as a leader among trial attorneys throughout the Rocky Mountain Region by multiple trade associations and independent publications. Mr. Powers’ career focuses on civil litigation and business regulation, with an emphasis on insurance defense and complex commercial disputes. He has served as lead counsel in state and federal trials involving insurance bad faith, arson, fraud, environmental hazards, automobile, personal injury, misrepresentation in real estate transactions and skier liability. Mr. Powers also is recognized for his expertise in the area of complex insurance coverage analysis. Mr. Powers has supervised claim investigations, taken examinations under oath, and advised in all manner of insurance claim determinations. While the bulk of this experience involves fraud and arson in the area of property and casualty insurance, Mr. Powers often is retained to resolve questions concerning errors and omissions, business losses, complex commercial losses and automobile claims. He has acted as a consulting expert, including matters involving the post-litigation defense of claim denials and attorney malpractice.
